 Chapter 13, Chapter 7 Bankruptcy

Not All Debts Are Dischargeable.

There are  debts that are dischargeable in bankruptcy.  Below is a list of Non- Dischargeable debts.   As with anything on the internet,  but sure to check with your attorney for the latest update.  

 Debts which are not discharged include the following debts:

1.   Alimony and child support. Support obligations that are past due can not be discharged.

2.   Certain taxes.  (Most taxes can NOT be discharged: Federal, state and municipal taxes that became due within the last three years. Soon taxes over three years old can be under some circumstances.

      Can’t discharge taxes if you have not filed the return either.

3.   Debts for certain educational benefit  (Student Loans);

           There is an exception to this rule. Although there is a general policy not to     discharge student loan debt, for hardship or particular circumstances it may be dischargeable. Most of the time the court does not discharge the student loan debts.

     4.      Overpayments or loans made or guaranteed by a  governmental unit;

5.     Debts for willful and malicious injury by the debtor to another entity;

6.     or to the property of another entity;

7.    Debts for death or personal injury caused by the debtor's operation          of a  motor  vehicle while the debtor was intoxicated from alcohol or other substances;

8.    Debts for certain criminal restitution orders, 11 U.S.C. § 523(a);   (These debts includes all court fees and court-ordered judgments related to any criminal activity cannot be discharged -- neither are any judgments or debts incurred as a result of personal injury or death to others caused by your own negligence or criminal activity). In other words if you commit a crime you can not discharge the fines or the debt relating to it.;

9.   The debtor will continue to be liable for these types of debts to the extent that they are not paid in the chapter 7 case;

10. Debts for money or property obtained by false pretenses;  this includes Fraudulent debts -- Any debt that the court finds was obtained fraudulently or illegally will not be discharged. 

      For example, if you ran up debt on a credit card shortly before filing bankruptcy (within 60 to 90 days of filing), the court will refuse to discharge that debt. In addition, if you have lied on a loan application to obtain funds the debt will not be dischargeable. -- that related debt will not be forgiven in bankruptcy.  The good news more credit card company does not investigate the debts and if you been paying on the debt for a period of time prior to bankruptcy then the court would take that into consideration. Mistaking the information does not necessary means you were trying to be fraudulent.

11. Debts for fraud or defalcation while acting in a fiduciary capacity;

12. Debts for willful and malicious injury by the debtor to another entity or to the property of another entity will be discharged unless a creditor timely files and prevails in an action to have such debts declared non-dischargeable.

       13. You can not incur Dischargeable debt to pay off non-dischargeable   debt – An  example of this would be to take a cash advance on a credit card to pay off last year's taxes or student loans, just so you can write it off in bankruptcy. 

     14.  Alimony and child support payments (court-ordered) are not dischargeable. Also  property settlements from a divorce are not dischargeable unless the other party agrees to it..  But your attorney fees from the divorce would be, but the attorney fees to the opposing attorney as for support would not.

If you have one or more of the items listed above you are not a good candidate for Chapter 7 bankruptcy.  However you still could be for a Chapter 13 bankruptcy as long as you meet the requirement. Majority of the people do meet them as long as they have an earn income.  To qualify for Chapter 13 bankruptcy, you must have an income that allows you to pay back your debts over a 3-5 year period.
